Adoption of my ''son''

My friend Phillip has two children. One is not his. They both have the same mother. She ran off due to drugs earlier this year. The biological father wants nothing to do with his son. He tried to force a miscarrage by beating the mother when she was pregnant. Phillip wants to leaglly adopt the boy. He is the only father he has ever known. I told him he must prove that he is capable of holding a steady job, home and provide for the children. He fears losing the boy to the state, due to his being single and mexican. If there is any advice you could give, or help, please let me know. I am doing the research for him due to my having time too.

There are too many factors to be considered to answer your question on the internet. He must contact anattorney and discuss the facts with the attorney. He must discuss the reasons that he fears that the court may take the children from him.

Family code section 3041 allows a non parent who has taken the place of aparent to gbet custody.
