Legal Question in Family Law in California

Adoption & Support

I am divorced and have raised his children my step-daughters since ages 8 months and 18 months. They are now 10 and 11. I have been legal guardian since 1998. I am now looking into adoption. Dad has not been in the picture for years and has never provided financial support. Is there some type of financial support I would be entitled to by adopting the children? I hope you can answer my question. Thank you so kindly, D from California

Re: Adoption & Support

If you adopt the children you would become the parent and would be responsible for their support. Also it is difficult to complete a single parent adoption.

You do not need to adopt the children to receive child support. Contact either the local department of social services to obtain AFDC or the local family support department and request assistance in obtaining child support. A private attorney can help you obtain child support, but you will have to pay the attorney's fees.

Reply: Adoption & Support

The adopotion would necessitate a termination of the parental rights of the father. Thus, he would no longer be legally required to pay child support. You would become the legal parent and you would have the obligation to support the child.

I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
