Legal Question in Family Law in California
Adopton
I have been with my Fiancee for 2 years we have a 2 month old child together and I have 3 from a previous marriage and he has 1 from previous relationship. I have custody of my children and his ex has custoday of there daughter she is not married and wants my fiancee to sign over parental right. He does not want to. We call at least 2 times weekly to see his daughter and they do no respond because they do not want her to be confused about who her dad is and how my son is her half brother. Is there any way that they can do anything with out my fiancees consent? How can we get some visitation? Also because my fiancee is not a citzen of the US will that effect him getting visitation or any custody?

Re: Adopton
Your fiance's immigration status has nothing to do with it, it is not relevant and no issue.
He needs to file a legal action and enforce his custody rights. If the mother wants to try to terminate his parental rights, she needs to show a lack of support, contact and money, from you fiance and it's not easy. If he calls like you say and can prove it, she can't win that argument.
