Legal Question in Family Law in California

Affair

I have been married for 7 months. In this time my spouse had

already an affair. We are over the situation but she is again in

touch with the same person. Is there any legal action I can take to

stop this? Can I use fraud as a reason for divorce separation? If so

what the consequences would be? What is the wisest decission I

can take?

The grounds for dissolution of marriage are "irreconsiable differences". Fraud, if it exists, would be grounds for anullment.

In regard to saving your marriage, I suggest counseling. In regard to dissolving your marriage, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

Re: Affair

You do not need any grounds for a separation or divorce other than that you no longer wish to be married. Good Luck, Pat McCrary
