Legal Question in Family Law in California
Agreed to Pay Child Support until age 25
Years ago, I agreed to pay child support until my child reached the age
of 25 or finished a four year college degree. The agreement became
part of the divorce judgment. Through an agreement with the DA's
office, I later stipulated to a doubling of the support with the
understanding that I would only have to pay the support until my child
finished high school. The DA's stipulation and order however didn't
reflect that, but their computer records indicate that support ends when
my child finishs high school. The stipulation limits the modification to
only the terms in the stipulation. In this case the amount of the support.
On a second occasion, I stipulated to another doubling of support and
with the understanding. My child recently graduated from
high school and I sought to have my support terminated. However, my
ex-spouse has produced the divorce judgment and is arguing that only
the amount of the support, not the term of the support has changed.
Am I screwed? Do I have to continue to pay support for six and half
more years, and at the expense of my two other children with my current
wife?

It is very unusual to pay child support beyond the 18 birthday. It also very unusual to agree to double the amount. I would need to see the judgment and the stipulations. Call me directly at (619) 222-3504.
