Legal Question in Family Law in California

Alimony & child support

I have been married for 2 years. I'm a homemaker & I have a son that's a year & a half. My husband & I are probably going to separate or divorce. He makes 60k a year. I think a divorce in CA isn't final for 6 mo., so do I have to wait until the divorce is final before I'm able to receive alimony & child support?

Re: Alimony & child support

No. If you separate you should file a motion, immediately, to set child and spousal support. The support can be set effective the date that you file your motion. Good Luck, Pat McCrary
