Legal Question in Family Law in California

Alimony

I have a girlfriend that lives in California. She is divorced and was married for 18 years. She has been getting alimony for approximatley 3 years. One year ago, she met another man and has decided to live with him in his or their house, but not to marry him. My question is, could she lose the alimony her ex-husband is paying her if she moves in with this man?

If she is cohabiting with a man there is a presumption of a decreased need for spousal support and therefore her spousal support could be reduced or eliminated. That is in California Family Code Section 4323. Good Luck, Pat McCrary
