Alimony
My ex husband has been ordered to pay monthly alimony. He has been five to six months late for a couple of years. He pays periodically, but not often enough to catch up. My car is about to become unusable and my place of employment is about to move farther away. I need his monthly alimony to pay off a couple bills and pay people back for the money I've borrowed over the past couple years. Then I need to buy a new car. Our divorce papers say that a change in either of our financial situations is not a reason to petition the court to change the alimony. I have received a substantial raise in the past year. I need to do something to get my alomony each month, and the money he owes me for what he's past due. I'm afraid if I sue him, he'll petition the court to stop paying me because of my raise. In spite of what the divorce papers says, I'm afraid he might succeed with this. I would like to know, if I call the District Attorneys office and tell them he is not paying as he has been ordered to... will they follow up? Do I have to personally sue him? I don't know what my options are.

The District attorney does not enforce spousal support. You already have a judgment and should be able to obtain a writ of execution to garnish his wages or to attache a bank account. The facilitators office may be able to help you or you may talk to an attorney. Pat McCrary
