Alimony

Hi-

I got married in Iowa in may of 2000. I met this man on the internet(I know-desperate or whatever) anyway i had bills paid up-2 jobs-a house and a car at the time and lost all because he moved me to CA and told me he would pay my bills-Well he introduced me to drugs and abused me for 2 1/2 years until I could make it back to Iowa in July of 2002. I want to know since I havenet worked since May of 2000 and he does -may I get alimony if I divorce him?

The answer to your question is, that alimony is possible. Among factors a court may consider in determining whether to grant support of this nature are the length of the marriage, the age and physical and emotional health of the parties, the distribution of property made in the dissolution, the educational level of the parties at the time of the marriage and at the time of the dissolution, the earning capacity of the party seeking maintenance, the feasibility of the party seeking maintenance becoming self supporting, the tax consequences to each party, any mutual agreement of the parties, the provisions of a prenuptial agreement and other factors.

Yes, you may be entitled to some spousal support (its not alimony in California). Unless your spouse has some contact with Iowa you will probably need to file in California. Contact an attorney in the county where he currently lives. Good Luck, Pat McCrary
