Legal Question in Family Law in California

Alimony

I was married for twenty years. I have been divorced for almost twelve. My divorce does not state how long I am to pay alimony. Is there a statue or guide lines used by the courts to determine how long I am too continue paying?

Thank you,

Re: Alimony

Generally a marriage of over 10 years will not have a termination date for the spousal support. You should consult an attorney who can review your financial situation and that of your ex-wife to see if you can or should file a motion to reduce or terminate spousal support. Good Luck, Pat McCrary

Re: Alimony

Your's is a long term marriage pursuant to the Family Code. As a result, there is probably no termination date. That is not to say that the support cannot be terminated. You really need to speak with an attorney to assess the situation and, among other details, review your income and the supported ex-spouse's income. Regards, Damian Nolan
