Legal Question in Family Law in California
Alimony
Weve been married for just over a year. She had a job when we married for a month then laid off. she didn't work for the next 7 months. She went back to work for the next 4 months quit and has now switched jobs again which she is due to finish at the end of this month for the season and going to draw unemployment for the next 3 months. I do make a little more than her but have child support and a car payment which I struggle to pay. She filed for divorce, but didnt file for alimony. She says that she can not live on what she is making. Can she get alimony? She thinks Im making such a huge amount. What would be the best way to defend against this? She does make enough to live on but chooses to take the easy road.

Re: Alimony
She may be able to get spousal support for a short period of time. If she files a motion for spousal support request that she seek employment. The state law has stated that the goal is for the supported spouse to become self sufficient within a time equal to one half of the length of the marriage.
