Legal Question in Family Law in California
alimony
I have been ordered by the judge to pay alimony to my ex until she either gets re-married or is in living arrangement like a marriage. She has been living with a man for the last 4 years. I need to know how and what would I need to present this to the courts. We have no children under the age of 18, and we had been married for 17 years. I went to med school and had taken out school loans to provide for us. However, I am solely responsible to pay the remainding 150,000 school debt off. Shouldn't she have to take part that debt? I can't imagine that I legally have to support her for the rest of her life. What can I do? Thank you and I appreciate any information.

Re: alimony
If she is co-habiting with a member of the opposite sex there is a presumption that she needs less support. Generally, a school loan is assigned to the party who received the education. However, payments on the loan do affect your ability to pay spousal support. You need to talk to an attorney about a modification of the spousal support order. Good Luck, Pat McCrary
Re: alimony
I would argue that she is in a marriage like relationship. DEMAND income and expense declaration, and set a hearing to reduce your payments. Alimony should only last 1/2 the length of the marriage and only when the spouse is not enjoying the quality of life that she was accustomed to during the marriage.
