Legal Question in Family Law in California

Alimony Requirements

My brother's wife wants a divorce after six years of marriage. His wife does not currently work and does not want to work. Her skills are more marketable than my brothers, and she could probably find a job where she gets paid more. She wants my brother to pay for all her expenses even though she wants a divorse. This will create significant undue hardship on my brother. Is there a miniumum marriage time requirement for a spouse to be eligible for alimony? Also, is there a way out for my brother not to pay alimony? Thank you

Michael

Re: Alimony Requirements

support payments are determined thru the family court system and are based on "need". your brother does have compelling arguments, so you definitely should suggest that he consult an attorney asap regarding this matter. if he would like a free phone consultation, email us back with his contact information today.

Spousal support is based upon a disparity of income and length of marriage. The longer the marriage, the more support.

I suggest that you advise your brother to consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
