Legal Question in Family Law in California

Is he allowed to tell the kids they have to move because he has to pay child sup

My wife's ex-husband was ordered to pay $850 per month in child support for two chilren ($430 more than the previous agreement) which they share 50/50 custody. He agreed to the stipulatons of the order without going before a judge. After the court date he began telling the kids that he may have to sell his house and move back to grandma's house because because, ''the law says that he has to pay Mommy money''. Now we have kids crying asking Mommy to not make Daddy pay her money because they don't want to have to move back to Grandma's house. Can he use them like that?

In a general sense, I would first consider family counseling to determine what was really said to the children and how to make it work for the children. Remember that often times children hear things differently than adults. If that does not work for you, you can go back to court and seek a modification of custody\visitation and or restraining orders preventing these types of discussions with the children.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
