Legal Question in Family Law in California
Alomony after payer retires
Marriage, originally in Calif., lasted 22 years, divorced in Utah in 1996. Payee lives in Nevada, Payer lives in Calif. Payee waived interest in retirement plan in exchange for house and deferred comp account at time of divorce. If only income source for payer is retirement income, is payee entitled to receive alimony after waiving interest in retirement plan?

What does your settlement agreement say. That will dictate who/what entitlement. If not given alomony when divorce final and in agreement, court usually gives up jurisdiction upon agreement of all. Need more info.

Since your question pertains to a Utah divorce, you should consult with an experienced family law attorney in Utah and or post this in the Utah section of Law Guru.
Good luck to you.
