Legal Question in Family Law in California

Amicable Couple Divorce question

My wife and I have been married for over five years. We wish to get a divorce at this time. We are friendly and have already agreed to split all our investments and holdings equally without any fights. We have no children either. What is the easiest and fastest way for us to legally end our marriage?

The easiest way to do the deed is to have an attorney prepare a marital settlement agreement (MSC), file the necessary paperword with the Court, and walk the "uncontested" paperwork through the Court. I have done this many times. You will still need to wait 6 months for the divorce to become final, but you could actually get everything done quickly.

In a general sense, I would serve your spouse with a divorce petition (and related pleadings), marital settlement agreement and preliminary declaration of disclosure all at the same time. If your spouse signs the marital settlement agreement, you can take default and submit a judgment.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
