Re: Annulment or Divorce?
You have to have grounds for an annulment. Check the laws of the state where you are a resident and where your husband is a resident. In California the most common ground for an annulment is fraud. Good luck. Michael Gray
Re: Annulment or Divorce?
Michael Gray's response was correct. Typical annulment grounds include that you're still married to someone else, your husband turns out to be your cousin.....it's unlikely you qualify, but check out your fact situation vis-a-vis the local laws.
If you're really seeking an annulment with your church (i.e., you're catholic & don't want to be excommunicated), check with your church's requirements. A divorce doesn't necessarily preclude obtaining a church annulment.
Re: Annulment or Divorce?
I NEED TO KNOW WHAT IS YOUR BASIS FOR SEEKING AN ANNULMENT AND HOW LONG HAVE YOU HAVE RESIDED IN THE STATE OF CALIFORNIA. CALIFORNIA HAS A RESIDENCY REQUIREMENT OF SIX MONTHS FOR FILING OF A DISSOLUTION OF MARRIAGE, HOWEVER THERE IS NO REQUIREMENT FOR FILING OF AN ANNULMENT. FURHTER, TIME LIMITATIONS FOR FILING OF AN ANNULMENT VARIES DEPENDING ON BASIS OF WHICH YOU ARE REQUESTING AN ANNULMENT.
