Legal Question in Family Law in California

Annulment Law

I found out my wife had a previous marriage back in 1985 that only lasted a week when she found out he was gay. They were never divorced or annuled and she is currently filing an annulment to him in Los Angeles County. The definition of an annulment states that the marriage never took place. If so would that mean legally my marriage with her would be legal if she annuls her marriage with this gay guy? Or would we have to annul our marriage too and remarry even if she annuls her marriage to him? We were married in Las Vegas Nevada and if needed I would prefer to file my annulment in Nevada if we find out we are not legally married. We would then remarry to make our marriage legal if required. We\'re hoping that when she annuls her marriage to this gay guy that it will make our marriage legal. Thanks in advance

Re: Annulment Law

It is my understanding that the marriage was void from the start. Thus having the prior marriage annulled would not make your marriage legal. You could have the first marriage annulled and then just to make certain you marriage is legal, have a confidential marriage. The record of this marriage is not open to the public. This would allow you to continue as though the marriage was legal.
