Legal Question in Family Law in California

Annulment

I was married less then 2 mo. ago I'm a disabled veteran and have had 6 surgeries. I take very heavy meds, oxycontin, methadone, norco, & soma. Well last month i caught my wife stealing oxy's. She claimed it would never happen again but i keep coming up short. Plus i jst found on her cell phone she's got text and calls looking for more meds and people demanding cash from stuff she already has recieved. By law is this grounds for the annulment as i prefer it rather then divorce. She also told me she had full custody of her 2 boys which i was gonna put on my ins. to help the boys. But again that was another lie. So thats not a possibility.

Re: Annulment

One of the grounds for an annulment is fraud. You may be able to get the annulment if you allege that she married you for the purpose of obtaining your pain medication. This may result in her being arrested on any one or more of several possible criminal charges. A divorce would require only that irreconcilable difference have arisen in the marriage. The difference is that a divorce is not final until 6 months after she is served.
