Legal Question in Family Law in California

Appointing a Guardian

I need to know what kind of document I need to have that will hold up legally to apoint a guardian for my daughter in the event something should happen to her father and I both. I need it to be something that can not be discredited, due to family disputes.

Re: Appointing a Guardian

This is not a family law question, this is a probate law question. You and he need to each have a will/living trust, and also a living will (advance directive) in case either or both of you is too ill or incapacitated to make decisions. I urge both of you to visit a lawyer in whom you have confidence whose primary practice is in probate law. He or she will advise you on the appropriate provisions in your estate plan regarding nominating someone to be guardian should this become necessary.
