Legal Question in Family Law in California

Appraising home childcare business for settlemen

For 18 years I have had a large family childcare business in my home. My husband had a small mechainic business also out of our home. However, I supported the family as he made little income. He is asking for half of the childcare business (and spousal support). My license is non-transferrable and clients have made their contracts with me. Family childcare can only be done in your home with the licensed provider living in that home. Would I still be able to sell the business to someone else? Can/should I have it appraised? What would the value consist of? I am very confused at this point.

I assume you are getting a divorce correct? The short answer to your question is not what you want to hear. Yes, the business is community property if it was built during the marriage, and yes he is entitled to 1/2 of the value thereof. There are various methods to value a business. If you are in Southern California you may call me for a free consultation.
