Legal Question in Family Law in California

In April 2009 I became pregnant with a man's baby who I had just recently met.Due to both sides of our family insisting on marriage we wed in July 2009. This marriage took place in county jail, he got arrested for a parole violation in June 2009. He had been previously married several years ago, but said that that marriage had been annuled just a few days after being wed. Turns out the day after we wed, he was served paperwork to be signed that legally ended his previous marriage.

Now as of March 2010 him and I have decided to end our marriage due to domestic violence. What I'm wandering is,can we have an annulment due to the fact he was legally still married on the date we married? I know there will also be an issue with working out the child custody at a later time, but as far as ending the marriage, what would be reccomended as the easiest fastest way?

Technically you need to go with an annulment, because the marriage was not legal.
