Legal Question in Family Law in California

Arrearages complaint after 7 years

I understand that Family code section 17800-17804 states that complaints should be made within 90 days, yet my ex wife has served me through DCSS claiming I owe arrerages from 7 years ago. We are now going to court. Will the Judge keep this law in consideration? Thanks

Re: Arrearages complaint after 7 years

You mis-read the law. That section applies only to complaints against the Department of Child Support Services. There is no limitatin period on the collection of child support. You need to talk to an attorney to prepare your case. Good Luck, Pat McCrary
