Legal Question in Family Law in California

Arrears

My boyfriend never had his support adjusted when we had our two daughters, therefore he owes $60,000 in arrears. This figure is not accurate as our situation had changed twice over the years. My youngest daughter was just diagnosed with Leukemia we're struggling to make the payments. The support payments are $700 due to the $350 a month for arrears and $350 for support. Is there any way to get the arrears adjusted? If so how difficult is it? Do we need a lawyer or can it be done by us? Is there anyone who specializes in this type of situation? If so how much does it cost? Thank you in advance for your time.

Re: Arrears

Arrears can only be adjusted if there was an order modifying the support, otherwise it continues until a subsequent order modifies the support. Arrears can be negotiated down though depending on the particular situation. Either with DCS or the obligee.

Good luck. Please seek local attorney before taking legal action.

Re: Arrears

The problem is serious. The monthly interest on the arrears could be as high as 500. You need to gather the court order and other documents related to this matter. Then contact a family law attorney in the county in which the case is filed in court.
