Legal Question in Family Law in California

Arrears child support and over paying child support

When I returned from Germany to Michigan in 1992, I found that I had arrears child support in the sum of $4400.00. Going before a judge in Michigan, I was court ordered to pay $20.00 a month to get my arrears in order. I have written RIverside County attorney office on several different occasions and also have made several phone calls. Since 1992 I have already paid well over $11.000.00 for this arrears child support and Riverside states I still owe over$6100.00 to date. One set of documents that I have, showed my balances for every month back from 1994 - 1998. In July , 1997 my balance owed in arrears child support was $3579.47, the very next month my balance owed was $7638.33? When I gave up my rights of child, the support order did stopped. Some of my many questions start right there. After taking well over $11,000.00 from taxes alone and after so many years, I'm being told that my arrears is still over$6100.00? I have sent certified letters to Riverside DA, and I get no response. I do need further assistance. This means they will take it and I will have paid over $14,000.00 on arrears child support of $4400.00. Do you think you can help with this situation? Is there a telephone consulting fee??

Regards

Re: Arrears child support and over paying child support

I will first need to obtain a copy of your file from the court to determine what has happened. Then I will need to file a motion with the court requesting the District Attorney's Office to prepare an audit on your child support payments and arrearages. Further, I would like to know how your parental obligations/rights was terminated.

You may be entitle to a reimbursement, but that will be determined after the audit.

I will be able to speak to you over the phone for about 20 minutes as an initial consultation to see if I can assist you in this matter. You may reach me at 310-839-7700.
