Legal Question in Family Law in California

need help asap

My husband threw me and my 2 kids out 90 days ago.We are living in a barn freezing and have nowhere to go.My name is still on the lease can I move back into the house? What are my options?Please help asap

The family law court may order you to return to the residence and your husband to leave the residence, whether or not you are on the lease.

The Family Law Facilitator will fill out the forms for you at no charge, if cost is an issue.

Have you checked for a women's shelter in your area. They would provide you with a warm safe place to stay until you can remove your husband from the house. You should take immediate action as you could be charged with child endangerment if one of the children becomes seriously ill from living in the cold barn.

I believe the court would likely move your husband out, not you and your kids, however, get with an attorney now. Protect your kids.

Go to the family law courthouse in your county immediately and see the family law facilitator. You may be able to get a "kick-out" order removing your husband from the residence.
