Can she attach new wife's wages??

I am considering getting married to someone who owes back child support, and has their wages garnished to repay the back support. If we get married, can his ex attach my wages for his back support, too? Also, if she were to take him to court to re-figure child support, would they look at my income to figure it too, or just his still?

The judge would need to have information about the income of both parents. However, unless both parents are there the court will base support on the representations of the parent that is there as to the absents parents income. If there is a great difference between the income used and the actual income of the absent parent. You may be able to file a motion to set aside the order for support.
