Legal Question in Family Law in California

attorney charges

My attorney did not complete my responsive declaration my income and expense forms timely. She had 4 weeks to prepare this and had to mail it by overnight mail and charged me for this mailing. Should i have to pay for this?

There were errors on my income and expense forms even though I provided my attorney with all of the information she requested. My attorney also did not submit to the court my uninsured medical costs documentation which I had given to her. Should I have to pay for the full cost of preparing these forms?

When I called to speak to my attorney a few times, I was told she was out of the office. I asked if my responsive had been filed. On another occasion I asked the paralegal if the continuance we asked for was granted. Then I received a bill from my attorney for these calls. Should I have to pay for this? Could I file a report against her because she has not fully represented me and/or because of her billing procedures?

Re: attorney charges

You could potentially be charged for all of those items, however, based upon what you have said, it would not be fair. You have obviously lost confidence in your attorney and should probably seek another. You may wish to sit down with a face to face with your attorney and address these concerns to see if you can come to a mutual agreement or the problems can be resolved. It you cannot resolve the problems you may seek fee arbitration with the local bar association. Good Luck, Pat McCrary
