Ex wants attorney fee's paid

My husband received notice that his ex is wanting him to pay for her attorney fee's.

Brief background - they split and had verbal agreement to have 50/50. After some incidents between my step-son and his mothers new boyfriend my husband filed ex-parte for custody. He was not given custody but 50/50 was made legal.

Now ex is wanting him to pay her attorney fee's stating he took her to court with no cause and is more financially able to pay for these fees. What are the possibilities my husband will be made to pay?

The answer will depend upon the income level of each party. Since he appears to have obtained a the result he wanted, the determining factor would be the income levels. If his income is much higher than hers he may have to pay her attorney fees merely to insure that she has access to an attorney. She apparently is claiming that his motion was frivolous and it was not. On that ground only she should lose.
