Legal Question in Family Law in California
My attorney giving legal advice to my ex-spouse
I recently went to court and was a little hesitant but agreed to remove a restraining order from my ex-spouse. My attorney then gave my ex-spouse some legal advice on how to report his earnings and the name of an attorney who can file bankruptcy for him. Should I let this go or did my attorney overstep his legal obligation to me?

I agree with Ms. Healy. If the advice given was detrimental to your case then you should be concerned. However, your attorney may have provided advice to your ex that helps the case move along without issue. If this is the case then why worry about it.

If your spouse is unrepresented, your attorney probably told him things he needs to do in order to make your attorney's job easier in helping you. People who are representing themselves don't know what to do and it can really slow the whole process down. If it turns out that your attorney advised him in a way that hurts you, then you have something to worry about. If your attorney advised him only in order to get the ball rolling, then don't worry about it.
