Attorney legal fees

Does the court ever request the respondent to pay petitioner legal fees in a pending divorce case?? There are no longer lawyers involved since I could not pay and still owe money. If so what do I file with the court to get this heard??

I am now on welfare with 2 children and he is over $25,000 behind in support. He has now filed for modification of support, he is hiding money from his own small business. Claims to the court that he makes no money and I discovered a bank account that he had deposited over $100,000 into in the past 12 months. I submitted this info to the court in my response, I am sure it will disapear now that he knows I know. What can I do?? FYI, this is in Calif.

You can file a motion for enforcing child support orders and then ask for attorneys fees while you are at it. It will be up to you to prove your need and his ability to pay though.

The court has the discretion to order him to pay your attorney fees. To get the order, however, you will probably have to prove he has the present ability to pay.
