My attorney was negligent?

A was ordered by superior court to increase my child support, I hired an attorney who was to file a motion and he did not do so. What can I do? I have hired a new attorney and he says I have to pay it, is there any mercy one can plea to the court

California family code prohibits the retroactive changing of child support. Child support can be modified for payments due after a motion to modify support has been filed.
