Legal Question in Family Law in California

Attorney Obligations

An attorney has not delivered documents as promised. What recourse is there?

Contacted attorney 5 months ago to 're-do' child support agreement as circumstances changed (both parties verbally agreed to changes). The attorney understood the urgency and committed to case. The documents have yet to be produced & calls are not returned. Attorney has made multiple commitments to complete the paperwork but has not done so. In the meantime, paying full child support to ex-husband and experiencing financial problems as well as enduring severe stress and anxiety.

Re: Attorney Obligations

if your former attorney caused you any damages as a result of his unreasonable delays in handling your case as promised, you have recourse for a malpractice suit against this attorney. in the meantime, since time is of the essence for you, you may want to have a new attorney draft what you need drafted asap. if you need further assistance, contact me today.
