How can I get a former attorney to return my case file with all my discovery needed for my current divorce case?

You need to send him a letter and request your file. An attorney in California has not right to retain a client's file after he has been terminated, even if the client still owes him money. Your new attorney should have done this. You should give him a reasonable time to return your file. I deem two (2) weeks a reasonable period, especially with ongoing litigation.

I agree with Mr. Roach and would add that if it has been more than two weeks and more than two requests, contact the State Bar.
