Attorney's Fees

If the wife is disabled (receives disability) and has not worked for the duration of the marriage, and won't be able to work following the divorce, will she be liable for the attorney's fees, or will the husband be expected to pay the fees?

Attorny's fees are based upon the need of the requesting party to have an award in order to have adequate representation and the ability of the other party to pay those fees. If the disabled person has no other assets to pay the fees, she will probably get an award of attorney's fees. Good Luck, Pat McCrary
