Legal Question in Family Law in California
My aunt passed away last year and left three daughters. One turns 17 next month, one turns 13 in november and a baby who just turned one two weeks ago. The baby has a father, but nobody in the family ever liked him or trusted him. We want to keep the girls to stay together, they want to be together. The father of the oldest has been out of the picture for many years. Their current guardian,father of the 13 yr old is moving to Vegas and they want to stay in California.We want to know if their grandparents,from their mom, can take custody of the three if them. They live in Mexico, but they are willing to move here and to fight for them. Can they fight for their custody?

They can try, but over the objection of any of the fathers, it will be a really tough fight to get a court to agree. Basically the father(s) who object would have to be unfit parents. Otherwise, they win. If the fathers agree, however, and if the maternal grandparents can prove that they can legally reside in California and support the girls, then it would be relatively easy.
