can I avoid the petitoner's presence on my depositon

Hello

I have a deposition sceduled as a witness on my brother's divorce case. Last two years I have been having anxiety attacks from the smallerst stress. I afraid that I might have one in the office if the wife is there. Can I ask the lawer that I don't want her presence there?

You can ask. Make sure you give the reason and let them know that you will be able to give a better deposition if she is not in the room.

Understand, however, that since she is a party, she has a right to be there.
