When a baby is born, is the baby required to take the surname of the parents or could the parents choose a different surname?

I'm a little confused. Do you mean that the baby is to have a surname different than the father, like the mother's surname? This is not a problem if the father consents. If not, you will have to go to court.

Or do you mean that you want the baby to have a different surname than both of you? Why would you do this? I advise against it.
