can he take my baby?

Hi,

My name is Martina, Originally I am from Europe. I live in Ca for 2 years. Have permanent green card. I have 2 months baby, and am not marred to the baby's father. I still live with him but we do not get alone and I want to move in my mom's house. My mother lives in Ca for 16 years and have own home.

My question is- can the father take way from me the baby/as he treats me/? I am a good mother and do not use drugs or alcohol. If we are not marred couple

what are his rights.

Will appreciate your answer.

He cannot take the child from you merely because you move to your mother's home. You should consult with an attorney regarding the procedure you should follow. If father has not taken steps to establish paternity, there is probably little he can do until he establishes that he is the father. Once he establishes paternity, he will have the rights and obligations of a father. That is visitation rights and the obligation to pay child support. Children, especially when very young, are seldom taken from the mother.
