Legal Question in Family Law in California
Baby's Mother Moved and now I can't find them what can I do?
In May of this year I filed for Joint Custody of my Daughter because he Mother said that if I wanted to see her I needed to go to court so I did. On July 11th the I called the Courts about my paper work they told me that I had gotten what I asked for due to the fact that my child's mother didn't show up to court. The paper work was sent to her last known address stating that I was to be able to see my child, so the court told me to wait a month and if I got no response then to take the next step. But I am not sure how to take that next step, if I can't find her in Virginia and she has moved back to California how can I get to see my baby girl. She is 3 years old and I haven't seen her in 8 months. After my child's mother started to date a Navy man I was seeing her very regularly and then she just stopped in January. I need some advice please. Thank from a Distress Father.

If the mother has recently absconded with the child to California or to other parts unknown, you
have little choice now but to try to follow up on your own with her relatives, friends, or others who may know(or be able to discover) her whereabouts.
Then, in about six months or so,if you have had no success with your own efforts, and after the mother may have begun to establish a record of
her new address in whatever jurisdiction she's residing in, you can go to the Division of Child
Support Enforcement(DCSE)and request to apply for their Parent Locator Service, which will initiate
a broad-based search throughout the United States.
(A comprehensive search will require that you provide her Social Security number.)

If you indeed have an order granting you joint custody and the mother is not giving you access to
the child, contrary to the order you need seek to have a rule issued by the court to enforce the
order. However, your description of the proceedings to date seems a bit confused. You really need to either have all your paperwork and perhaps even the court file reviewed by a
knowledgeable attorney to make sure exactly where you are at or you should got to the court house and pull and review the file to make sure you are correct in your understanding of the status of your case.
