Legal Question in Family Law in California
Babysitter Fees
I am responsible to pay for 50% of babysitting fees for one minor child (7). This is only for the time my ex is physically at work, and the ex must provide timecards and receipts to verify that it is work related. Currently my child is in the care of a sitter due to work 30% of every month, that does not include school, after school programs, and personal use sitters. My ex also has a live in boyfriend. If she tries to charge me for the boyfriend to watch the child am I responsible to pay for that as well? He has been in the home for about 10 month, she has not charged for his time yet (that I know of). Also since she is required to proved information on her schedule, should she be providing proof that the boyfriend is not able to watch the child?
I live out of state, the child is 7 years old, we share legal custody, she has primary physical, I get 10 weeks a year plus she gives an extra 2-3 weeks to free her summers up from the child.

Re: Babysitter Fees
What you are obligated to pay depends upon what your court order says. You can agree by stipulated order to split more things than the court could order. The court can order you to split the cost of childcare related to her employment, but no childcare (baby sitter) so she can go out. Her boyfriend has no legal obligation to do anything, so forget about him. If she were to try to pay him saying he was providing the care, courts tend to be skeptical of such arrangements.
