Legal Question in Family Law in California

Back Child Support Claim

My husband's ex-wife (10 years divorced) who seems to have some long term emotional and financial problems is claiming back child support owed to the tune of $7K. This is incorrect and nothing is owed. After raising child support to $500 per month two months ago, she is requiring $700 a month child support.

What can be done? What is the norm for child support?

Thanks so much.

Re: Back Child Support Claim

You should have an attorney run a computer program to determine what the correct amount of child support should be. As far as a claim for money owed, I am curious why that is a problem. Your husband's ex cannot get the money without a court order--the court will have to make an order regarding the amount owed. If there is a court action pending, you will need to show the court that nothing is owed. I suppose, if you really want to, you could bring an action in court to determine that your husband owes no back support.
