Legal Question in Family Law in California
Back child support that has already been paid
This question is from our son-in-law to be. His divorce became final in April of 1995. It was uncontested so it went through a mediator in a divorce court in Los Angeles. The divorce decree stated that he pay the petitioner (X-wife) the child support. He has paid this every month since this time. He has received notice that he owes $7300.00 in back child support, & has been turned over to a collection agency and IRS. He has sent copies of all cancelled checks, noone will respond How can this be resolved without going to CA?

I assume from your post that your son-in-law has made all of his required payments. It may be that he was ordered to make the payments through the court and he paid her directly. If that is what happened, then there is no record of his having made the payments. He will probably need a CA lawyer to help him straighten this out. Just sending the cancelled checks (copies I hope and I hope he still has the originals) would not be enough in most cases as evidence must be properly presented at the correct time, generally speaking.
If we have not met face to face and agreed to my representation of you in a written agreement signed by both you and I, then I am not your lawyer. Any comments made here are not legal advice but presented in the spirit of this bulletin board as general information only.
