Legal Question in Family Law in California
Back Child Support even if there was no previous order?
My step daughter has been living with me for almost 4 years ( she's almost 7 now ). Her mom left the bio father when she was three and was awarded custody with no visitation ( after a couple of restraining order violations ). ~6 months after being awarded sole custody with no visitation by the bio father, I moved them both from OR to CA, we've been here for 3 1/2 years. We never persued child support before, ''well enough left alone'' syndrome, and I have been able to provide just fine for us all. Now that things have settled some, can we petition the court in CA for support from the bio father?

Re: Back Child Support even if there was no previous order?
The California courts would not have jurisdiction over the father to order him to pay child support unless he has "minimum contacts" with the state of California, like he works here, the child was conceived here or lived with the father here. Talk to an attorney as "minimum contacts" does not have a real clear definition. Probably you will need to bring an action is Oregon, if father still lives there. Good Luck, Pat McCrary
