Legal Question in Family Law in California

Back to court so his x-wife can get more child support

My husband and I live in Las Vegas NV. His daughter lives in Fresno CA. His X-wife just sent papers to go back to court so she can get more child support. We would like to know now that we are married and have a house payment and two car payment and a lot more bills then the last time she took us to court the paper work they sent my husband to fill out only asked what his gross pay is and what his house payment is and nothing more how come they did not send a afadavid so that we can list all are bills. Is this normal for the CA courts to do. And can they use my income as well.

Re: Back to court so his x-wife can get more child support

In California support is determined by the gross monthly income of each parent, percent of visitation, and the actual taxes paid. Thus the new spouse income is considered for the sole purpose of determining the actual income taxes paid. The property taxes and interest paid on the family home are considered to the extent that they decrease the amount of income taxes paid.

You should consider contacting an attorney regarding the jurisdiction of the California court to set support, if you are a resident of Nevada.
