Legal Question in Family Law in California

Basic Procedure on filing for divorce

In a divorce that is mutually agreed by both parties, is it correct in California that the papers, once signed, are filed with the court, and that filing is followed by a six month cooling off period, after which the divorce is final absent any objection or withdrawal by either party? Or can it be finalized immediately?

Re: Basic Procedure on filing for divorce

It does take six months from when the divorce papers are first served to when the marital status can be terminated and the parties can remarry. Lots of paperwork must be filed first, however. It does not happen automatically.
