Legal Question in Family Law in California

Biagamy and Child Custody

I was extremely stupid years ago and got remarried while still married to my first husband. My new husband knew that my first marriage was still valid. After years of marriage together we had a child but the relationship turned very bad and I left him. He was shipped off in Iraq and I used this time to get away from his abuse. He was discharged from the military 7 years before the end of his reenlistment contract. I moved back to the place we met, lived and conceived our child. He stopped paying child support as soon as he got discharged and now is threatening me to get custody of our child. He even contacted my first husband and convinced him not to divorce me without a struggle. He has not seen his child since he was discharged in February and moved to his home state of Florida. Also he was stationed in Northern Georgia when I left him to go back home to the west coast. I know what I did was wrong, but how can I fix this now so he can't get our son. He was discharged from the military for being unstable (crazy).

Re: Biagamy and Child Custody

Your marital status at the time the child was born will have little or no affect on custody. You should open a case with child support services in the county in which you reside. This department should find him and get a court order for him to pay support and enforce the order.
