Legal Question in Family Law in California

Bifurcation in California

Can a bifurcation procede in CA without both parties in agreement. The divorce is uncontested and the only issue now is settling and there are problems now with refinance of the current home that the respondent will be buying out the plaintiff. It has been well over the 6 months and 1 day. What should we expect out of this? Plaintiff would like to remarry and Respondent is dragging this out by not aggressively trying to secure funding in a timely manner.

A bifurcation may be something you can agree to, otherwise a hearing on the status issue will have to be had.

Good luck.

As always please consult a qualified attorney before taking legal steps.

A motion for bifurcation would have to filed. If the court grants the motion then the marriage can be terminated and the other issues dealt with later.
