bigamy?

me and my boyfriend want to get married, but he was previously married in california. As far as he knows he is divorced, but does not know for sure. How can we find out and what happens if we get married believing that he was divorced?

One is either divorced or not. Unless one was in a coma, it is almost impossible not to know which. Contact the district clerk in the California county in which he thinks he was divorced. They will tell you. That simple.

First, I would make sure he actually is divorced, then you will not have a problem. However, should you get married before his divorce is final, believing it is final, then you would have what is called a putative marriage, which means you would have all the rights and obligations just as if you were legally married, but a whole mess of legal issues to deal with (i.e. big attorney fees). I can help you find out if your boyfriend's divorce is final and if not, help him to make it final.
