Bigamy

My fiance is from Australlia and is also married but going through a divorce. If we were to get married would she get in any trouble even though her divorce will go through in feb. If so how would she be found out, and what are the penalties?

The new marriage will likely not be valid, so wait until the other one is legally ended.

Potential criminal charges are not the only problem she could encouter in this situation. At some time in the future the validity of the marriage may be challenged for financial reasons. She could lose any community property rights that she would otherwise have.

There may be other problems tha could occur in this situation.
